These terms of use (these “Terms”) represent an agreement between you and Heartspace Circle, LLC. and Somos Yoga, LLC. (“we,” “us,” “Heartspace” or “Heartspace Circle”) and govern your use of our websites at heartspacecircle.com and other sites created by us from time to time (the “Sites”) and any products or services made available by means of any of the Sites (the “Products”). We refer to the Sites and the Products collectively in these Terms as the “Services.” By using any of the Services, you acknowledge that you have read, understood, and agree to be bound by and comply with these Terms.
Services
Heartspace Circle grants you a non-exclusive, non-transferable, revocable license to use the Services, including the Products (subject to payment, where applicable), for your personal use only, in accordance with these Terms. We reserve all rights that we do not expressly grant in these Terms. We may change, suspend or discontinue any aspect of the Services at any time, including the availability of any feature or content. Without limitation of any of our other rights or remedies at law, in equity or under these Terms, we may terminate your license to use the Services, in whole or in part, including your right to use any Products, without providing any refund or canceling your obligation to make installment payments where applicable, if we determine, in our sole discretion, that you have breached or violated any of the provisions of these Terms. If you are using the Service on behalf of anyone else you are responsible for ensuring they comply with these Terms and will indemnify us for any breach of these Terms that they commit.
Medical Advice
If medical and/or psychological advice/treatment is needed, please contact the appropriate medical professional. We do not give medical and/or psychological advice or treatment. Self-improvement modalities are designed to assist in the process of personal growth and self-improvement.
Clients with active mental health issues/ episodes must have a primary therapist that they see on a regular basis, before using my services as secondary support that compliments the work of the licensed therapist.
Should anything surface from our session that requires a licensed therapist, any future sessions will not be booked until a primary therapist is secured and the therapist has permitted sessions to continue
Bookings
Clients can book a session. As a condition of being permitted to book Sessions, clients agree with the following terms for all appointments booked. The following terms also apply if you book a session without first completing the registration process.
You must accurately complete the registration process.
Substance Free Policy
To participate in any private session you agree to be free of any substances that alter your mind or mood. Failure to adhere to this policy will result in a session cancelation and will be treated as a no-show and charged the full cost of the session.
Late Arrivals
Unless given prior notification, there is a 10 minute grace period in which a client can be considered tardy for their appointment. If more than 10 minutes late, you may be rescheduled based on the practitioner’s availability or seen during their scheduled session time in which the session will end at the originally allotted time.
Cancellations
There is no cancellation fee for private sessions canceled at least 6+ hours before a scheduled start time. Sessions canceled after 6 hours are subject to a cancellation fee of up to 20% of the cost of the booked session. Sessions canceled 2 hours prior to the start of a session will be charged the full cost.
Fees
The fees listed on the Service are the standard fees for the listed service, which Heartspace Circle may change at any time in its sole discretion by so posting on the Service. In addition, fees for services provided by a Coach may vary depending on a variety of factors such as length, day, time, or location of the appointment. The fee you are ultimately charged is the “Fee.”
Responsibility for Payment
You agree to pay to HeartSpace Circle all fees, whether or not you dispute the amount of the charge or the quality or nature of the services provided.
You may purchase licenses to certain Products through a one-time payment or in monthly or yearly installments, as specified on the Sites. When you make a purchase, you authorize us to charge the credit, debit card account, or other payment methods you provide on a one-time, monthly, or yearly basis, depending on which payment plan you elect.
We reserve the right to cancel any order for any reason. Possible reasons for cancellation include but are not limited to the following: fraudulent or potentially fraudulent orders, incorrect pricing, or non-payment.
In making use of the product or services you agree that you are responsible for the full payment of product or services whether you select a one-time, or monthly payment plan and will continue to pay monthly payments for subscriptions you purchase, and any and all payments will continue on the payment schedule you have agreed to pay, even if you do not commence or use the product or services or do not attend the classes or events associated with the product or services.
Dispute Resolution
All sales booked through the Service are final and HeartSpace Circle provides no refunds.
Refunds
All sales are final and there are no refunds.

All client information, discussions, notes or documentation, or discussions are confidential and will not be shared with any related clients unless required by law.
I act as a mandated reporter for both adults and minors if anything were to surface in a session regarding doing harm to themselves or another person.
Your Content
We may provide the opportunity for you to provide content or materials (“Your Content”) by means of the Services, including by commenting on blog posts, by communicating with us directly, or through other forums. You grant to us and our affiliates a non-exclusive, perpetual, irrevocable, royalty-free, worldwide, assignable, transferable, right and license to reproduce, display, perform, transmit, modify, publish, create derivative works from and otherwise use Your Content in any formats or media now known or hereafter devised, in any manner whatsoever.
Changes
We may modify these Terms at any time by posting changes on the Sites; however, (i) these changes will only become effective and binding with respect to you after we provide notice on the Sites that these Terms have changed and you first use any of the Services following the date of such posting, (ii) the changes will only apply with respect to your use of the Services after such changes become effective, and (iii) any change in payment obligations will only apply to your subsequent purchases on, or usage of, the Services. If at any time you find these Terms unacceptable and do not agree with them, you thereafter will have no right to use or access the Services.
